A MECHANISM TO ENSURE THE ENFORCEMENT OF LABOUR DISCIPLINE AND ITS ELEMENTS

Abstract
The article is devoted to one of actual problems of labour law on the issue of ensuring labor discipline. Reviewed and analyzed current theoretical achievements of scientists sanctions against designated as a mechanism to ensure labor discipline in the structure of labour standards. Proposed own vision of classification of sanctions in labor law. Topicality of the article is due to the need to consolidate and further develop knowledge about sanctions and their role in improving labor discipline. The theoretical framework for the study allows us to deepen our understanding of the nature of legal regulation and its effects on the human circulation. For practice important recommendations for the improvement of sanctions with the aim of increasing the effectiveness of the law. With transition of Ukraine to a qualitatively new type of economic relations – of the market – raises a topical issue of improvement of legal regulation one of the foundations of social production and labour relations. Important to ensure the proper behavior of actors in these relations are the measures of legal enforcement, especially sanctions. The introduction of an effective system of sanctions is aimed at ensuring adequate legal regulation of labour relations in Ukraine. Sanctions as coercive measures play a significant role in the preservation and protection of the rights of participants of labour relations, are the means to ensure accurate and strict observance of norms of labour law, execution of labour duties. But, unfortunately, the labor legislation of Ukraine, regarding the establishment of sanctions, does not meet modern requirements for the realization and protection of labour rights and duties of subjects of labour relations, and the theory of labor law the issue of sanctions in the conditions of market economy is not studied enough. The process of reforming the labour legislation of Ukraine, which touches on the issues of legal liability and sanctions in the labour law needs to be applied recommendations for improving the system of sanctions in this area of law, reasonable modern scientific research.
