“ACCESS TO INFORMATION” AND “RIGHT TO INFORMATION” CONCEPTS IN DOMESTIC LEGISLATION AND SCIENTIFIC LITERATURE

Abstract
The paper explores the features of disclosure in the national legislation and legal literature of the concepts of “access to information” and “right to information”. The emphasis is placed on the fact that the category of “access to information” covers both access to open information of a kind of public information and access to restricted access information, namely confidential, secret and official information. It is concluded that “access to information” as a category of legal science and current legislation has different forms of manifestation, each of which is provided by the appropriate legal procedure, the violation of which generates certain legal consequences, including in the form of legal liability. It is noted that the term “right to information” is not always used in national legislation, although in legal science it is recognized as a unifying concept for all information rights of a person and is often interpreted in the law as the right to freely collect, store, use and disseminate information.
