ADMINISTRATIVE ACTIVITY OF THE NATIONAL POLICE OF UKRAINE ON THE PREVENTION OF MISDEMEANORS IN THE PUBLIC ORDER IN THE TERMS OF THE ATO

Abstract

Building a democratic society requires the citizen to fulfill his duties to the state and from the state to ensure the legal rights and freedoms of the individual. The Constitution proclaimed Ukraine a legal state and noted that the state is responsible to the person for its activities. The establishment and maintenance of human rights and freedoms is the main duty of the state. And in order for the citizens of the country to fully use the rights and freedoms granted to them, the state must ensure the proper state of public order, create a solid legislative base for the protection of public order and be responsible for ensuring it. The article notes that the administrative-jurisdictional activity of the units of the National Police has certain peculiarities that do not allow to identify it with other types of activity of the executive authorities. Under the category of «administrative and jurisdictional activity of the National Police» - a specific form of public legal relations arising when the units of the National Police exercise law enforcement activities covering cases of administrative offenses and the adoption of power decisions in accordance with the procedure established by law and forms to achieve certain legal results related to the application of measures of administrative enforcement of rights enforcement agencies. In general, the article explores the specifics of the administrative and jurisdictional activities of the National Police of Ukraine, analyzes the main scientific research in the field under investigation, presents the author's definition of the definition and specifies the features of the administrative law jurisdiction of law enforcement agencies, reveals the current conceptual approaches and specific application of the norms of misconduct in the current Ukrainian legislation against public order.
