ADMINISTRATIVE AND LEGAL REGULATION OF SPHERE SECURITY OF UKRAINE

Abstract
The article is devoted to the administrative-legal regulation of the security sphere of Ukraine. Scientific and legal analysis of current normative legal acts and scientific and theoretical sources on the given issue is carried out. It is determined that domestic legislation does not define the definition of “security of Ukraine”. Moreover, the domestic legislator instead of the concept “security of Ukraine” uses definitions such as “state security”, “national security”, “public safety”, “military security”. It is found that the term “safety” is a general notion of the quality of being, which can be used to identify many phenomena. It reflects not only specific features of a particular phenomenon of safety, but also absorbs its common features (factors) in itself, which allows it to apply it in many industries. However, the category of “safety” is not absolute, but relative, and its significance becomes meaningful only in the field of the concrete life of a person or society. Safety is closely connected with all components of society, which are the main factors of self-preservation, existence and development of the natural environment of each person in particular and society as a whole. Safety as a generalized concept must be considered in the triad dimension: man – society – the state. It is noted that administrative-legal regulation is a complex phenomenon, which in modern conditions of transformational transformations in society is filled with new content, and therefore, as a scientific category is actively studied by scientists of the legal science and needs constant reflection. As a result of the study, based on comprehensive, comprehensive, scientific analysis, certain gaps in the regulation of the investigated issue were identified and recommendations for their solution were given. In particular, it is established that the concept of administrative- legal regulation of the sphere of security of Ukraine in the legislation of Ukraine is absent and it is proposed to fix at the legislative level the definition of “administrative and legal regulation in the security of Ukraine” as the activities of state authorities aimed at the regulation, protection and development of social relations, arising in the field of security of political, ecological, scientific and technological, economic (financial), demographic, informational, social and military security of Ukraine and.
