ADOPTING AUTONOMOUS LABOUR LAW ACTS IN THE LIGHT OF ART. 30 SECTION 5 OF THE ACT ON TRADE UNIONS. THEORETICAL AND PRACTICAL ASPECT

Abstract
The Act on Trade Union imposes on an employer a general obligation to agree with the establishment trade union organisations on the contents of an in-house legal act which is intended to be implemented by the employer. However not all the establishment trade union organisations operating at the employer exercise the equal rights with this regard since the provisions of the Act on Trade Union give privileged treatment to the representative trade unions. If there are at least two representative trade unions operating at the employer they may exclude non – representative trade unions from the negotiations. In such circumstances the employer ignores the non – representative trade unions in forming an establishment legal act. In case of trade unions’ joint and negative position towards the employer’s proposal the employer is not authorised to unilateral implementation of the respective act. If their positions are different the employer should repeat the negotiations with the trade union organisations.<br/><br/>
