AGROINDUSTRIAL COMPLEX OF UKRAINE IS THE OBJECT OF ADMINISTRATIVE AND LEGAL REGULATION: PROBLEMATIC ISSUES

Abstract
Problem setting. The article deals with some problematic issues of administrative and legal regulation of the agroindustrial complex of Ukraine in order to bring the legislative base in this area in line with the provisions of the directives of the EU Council and other international standards. Target of research. The purpose of the study is on the basis of the analysis of theoretical foundations, legislative acts, to investigate the state of administrative and legal regulation of the agro-industrial complex of Ukraine. Analysis of recent researches and publications. The following scientists analyze separate aspects of the question in their researches: V. B. Averyanov, O. M. Bandurka, Y. P. Bytyak, V. V. Galunko, T. O. Kolomiyets, L. I. Myskiv, I. A. Chernysh and others. Article’s main body. One of the important means of strengthening the functioning of the agricultural sector of the Ukrainian economy, accelerating its development and establishment is the law. It establishes the organizational structure of the complex, defines the main parameters of its functioning. The legal norms regulate social relations, which concern practically all subjects of the agrarian and industrial complex of Ukraine. Obviously, for the optimal development of agribusiness in Ukraine, legal provision of its functioning is important. In accordance with the Strategy for the development of the agrarian sector of the economy for the period up to 2020, approved by the Cabinet of Ministers of Ukraine on October 17, 2013, the agrarian sector of Ukraine, the basic component of which is agriculture, is a system-forming factor in the national economy, forms the basis for preservation sovereignty of the state – food and, within certain limits, economic, ecological and energy security, ensures the development of technologically related branches of the national economy and forms the socioeconomic bases of rural development their territories. Among the main problems of the development of the agrarian sector are the following: uneven development of various forms of management with the simultaneous weakening of the positions of the average agricultural producers as a result of the creation of formally identical, but not equal conditions of farming for various sizes and social loads of agricultural producers; lack of motivation to cooperate and consolidate small agricultural commodity producers within the rural communities, weakening the economic basis for the development of rural communities, etc. Conclusions and prospects for the development. Taking into account the outlined problems of administrative and legal regulation in the field of agroindustrial complex of Ukraine, it is clear that only bringing the Ukrainian legislation in line with international standards will improve its current condition. It would be advisable to fix, at the legislative level, the definition of the Ukrainian agricultural sector, to prepare appropriate projects of normative legal acts that regulate the procedure for privatization of agrarian state-owned enterprises, registration of rights to land, etc. Particular attention deserves our proposals for amendments to articles 104-108 of chapter 9 «Administrative offenses in agriculture. Offenses of Veterinary and Sanitary Rules» of the Code of Ukraine on Administrative Offenses to avoid contradictions that exist now.
