Application Features of Contract Form of Labour Agreement with Academic Staff

Abstract
The article deals with the investigation of legal regulation of certain aspects of employment relationship with academic staff during the formation of a labour agreement (contract). The employment contract with academic staff lies in the signing of a labour agreement (contract). According to the Labour Code, a contract is a special form of labour agreement in which the period of validity, rights, duties and liability of the parties, terms of material security, work organization, conditions of termination of an agreement may be determined by agreement of the parties. However, the procedure for the appointment of academic staff is carried out by the signing of a contract or a labour agreement. In connection with the prospect of the adoption of the new Labour Code of Ukraine there is some concern about the future of the contract as a special form of labour agreement. Therefore, scientific research in the field of application of the contract in the labour rights remains relevant. According to the survey, it was found that the contract is always signed in written form, it is possible to provide additional rights and duties both of employee and employer, as well as additional grounds for termination of the labour agreement (contract), the parties may provide for the possibility of compensation for moral harm, the field of the application of the contract is determined by law. This allows the parties of employment relationship use the work force qualitatively, to attach skilled professionals, including for educational institution. The improvement of the existing forms of labour agreement (contract) with academic staff is proposed, as well as specific proposal to solving of the theoretical problems in this regard is formulated.
