BASIC PRINCIPLES OF OPEN SOCIETY LAW IN ANTI-CORRUPTION TRANSFORMATIONS OF LEGISLATION ON THE JUDICIAL AUTHORITY

Abstract

The article outlines the essence of the basic principles of the open society law in anti-corruption transformations of the legislation on judicial power. It is substantiated that the idea of the rule of law is the key. The basic elements of the core of the rule of law notion are the ideas of fairness, equality and legality. It is determined that the concept of “rule of law” is complex and framework for its concept, reflects the whole set of meaningful judgments about the domination of law in the conditions of anticorruption transformations of legislation on the judicial power of an open society, in particular, when they administer justice and other functions. Judicial understanding, observance and application in the conditions of these transformations of the public law of an open society involves the study of its elements, which are the principles of different content and/or volume, namely: equality, freedom, justice. It is concluded that judicial decisions are in line with the rule of law principle when they have become human rights, a priority that they have been provided more than any other values. At the same time, the degree of such provision allows us to establish an appraisal concept of “justice”. It is important not only that man claim was satisfied and right was defended. It will be fair for a person to ensure this right when he is satisfied that the court has provided his rights at the highest possible level, expressed in concrete figures and facts. It has been outlined that the principle of equality means that the judge provided human rights to the same degree for all. The court’s decision and the procedural rights of the participants in the case do not depend on any signs. Formally, these features do not give any advantages to the judges and none for any participants in the trial. These participants are endowed with equal procedural rights and responsibilities. It is stressed that the anti-corruption transformation of law in an open society presupposes the legal nature of the laws. They are the embodiment of progressive ideas of natural law, the concentrated expression of which were the values of the rule of law. At the same time, in closed societies, the content of the principle and the legality will be significantly divergent. Then the court is forced to apply unlawful laws, on the basis of which makes unlawful, but legal decisions. However, the court can as much as possible benefit citizens’ rights to interpret the current legislation. The role of judges in such politico-legal terms is substantially increased, since they in fact largely compensate inertia, backwardness and other variations of ineffective work of other branches of public authority, including corruption. Therefore, for such societies, the question of creating and functioning of a system for ensuring the impartiality and integrity of a judge is critically upgraded.
