Certification and Systemization of Genetic Rights

Journal Title: Medicine and Philosophy - Year 2024, Vol 45, Issue 2

Abstract

The impact of genetic technology on human subjectivity necessitates legislative protection for human genetic interests. Genes possess personality traits while also carrying economic benefits. The existing rights system cannot fully cover interest relationships in genetics, leading to the emergence of a new type of right known as genetic rights. The certification of genetic rights is based on the moral significance of genes, involving human species dignity, personal dignity, bodily dignity, and substantial economic interests. Genetic rights manifest as a multi-faceted right system, including genetic privacy rights, genetic equality rights, genetic informed consent rights, and genetic interest-sharing rights. Under the current legal framework in China, it is appropriate to improve the genetic rights system through a standalone law.
