Characteristics of the investigation stages of infliction of bodily injuries committed by minors

Abstract
In the article, based on the analysis of the opinions of scientists on the concept and essence of the scientific category «stages of the investigation», the actual understanding of the content of this concept is formulated. The essence and tasks of the initial and subsequent stages of the investigation into the infliction of bodily injuries committed by minors have been determined. Based on the analysis of the practice of investigation of crimes, typical investigative situations are identified for each stage of the investigation into the infliction of bodily injuries committed by minors. It was established that the initial stage is characterized by insufficient informativeness and short-term character, which forms its tasks and functions, the implementation of which provides the basis for further successful investigation as a whole. On the basis of an analysis of the opinions of scientists and the provisions of the current criminal procedural law, it can be argued that the initial stage of the investigation commences from the moment when the criminal police informs the police about the commission of a criminal offense and ends with the detention of a person and the announcement of a suspicion to him. From the forensic point of view, sufficient evidence has to be gathered at the moment that the person is involved in the commission of a crime. The next stage of the investigation continues until the investigator, the prosecutor believes the evidence gathered during the pre-trial investigation is sufficient for the purpose of drawing up the indictment. From the forensic point of view, all possible investigative actions must be carried out, the results of all expert examinations are obtained, and evidence base is fully formed. It is noted that the final stage in the current system of criminal proceedings can not exist. Investigative situations of the next stage of the investigation are formed depending on the suffi-ciency of the evidence and on the behavior of the suspect, in particular the degree of recognition or non-recognition of his guilt. As a conclusion, it is noted that the definition of the stages of investigation and typical investigative situations causing bodily harm inflicted by minors has a significant meaning both for the theory of criminalistics and for the practice of investigating criminal offenses
