CO-AUTHORS’ RIGHTS WHEN CREATING A WORK OF SCIENCE ON GROUNDS OF THE EXERCISE OF THE EMPLOYMENT AGREEMENT

Abstract
In the article the features of the acquisition and content of the rights of co-authors in the case of the creation of a science work in connection with the implementation of the employment contract are explored. There are established signs on which the work will be considered as created in connection with the implementation of the employment contract. The current legislation of Ukraine is analyzed and a number of amendments to the legislative provisions are proposed. The legal nature and signs of a separate agreement concluded between the employee and the employer on the distribution of property rights of intellectual property to an object created in connection with the implementation of an employment contract are described. The general and distinctive features between the creation of a work on the basis of an employment contract (contract) and the creation of a work by order on the basis of a civil law contract are investigated.
