DEVELOPMENT OF THE LEGISLATION ON ESSENTIAL VIOLATIONS OF REQUIREMENTS OF THE CRIMINAL PROCEDURAL LAW AS BASIS FOR CANCELLATION OR CHANGE OF THE JUDGMENT

Abstract
The article is devoted to a research of the main aspects of development of the criminal procedural legislation on essential violations of requirements of the criminal procedural law as the basis for cancellation or change of the judgment. It is established that the modern understanding of this legal phenomenon is advanced display of legal statuses which arose at the end of the 15th century and displayed essence of revision of judgments which characterized criminal procedure of a certain historical period. Need of new scientific judgment and research of the existing legislative provisions taking into account development of a procedural form, changes of the criminal procedural legislation and ensuring unity of practice of its application is stated.
