Development of the Ukrainian Normative Energy Base in the Context of Europe Legislation

Abstract

The article analyzes the process of lawmaking in the domestic energy sector during the years 1991-2017, which made it possible to assess the consequences of changes in the energy sector of Ukraine. It is noted that the legislative concept of changes in Ukrainian energy initially and consistently focused on liberal transformations of the fuel and energy complex and all energy. So far, no significant progress has been made in this direction, but this allowed to partially link the Ukrainian energy system with the European one. The beginning of the reform of the Ukrainian energy industry was set in 1994. With the adoption of the Law "On Energy Saving", and in 1995, the complex and full-scale transformations of the post-Soviet energy system of Ukraine to the formation of a new model of the energy market have already begun. The restructuring of energy sector has resulted in the massive privatization of oblenergo. However, these privatization measures did not ensure the inflow of expected foreign capital into the Ukrainian energy sector. The legislative field was marked in 1997-2001, when the law "On Electricity", the Law "On Alternative Energy Sources" and "State Support Program for the Development of Alternative and Renewable Sources of Energy and Small Hydro and Thermal Power" are adopted. It is noted that in the law "On Electricity" to stimulate the development of alternative energy, a "green tariff" was introduced, which generated significantly higher monetary payments for the produced and discharged electricity from alternative electricity generation compared to the traditional one. The ineffectiveness of the privatization processes in the energy sector was noted, which provoked the build-up of crisis trends in energy and aggravation of non-payments. In order to overcome these negative phenomena, a decision was made to form a wholesale energy market. At the same time there was a reorientation on energy efficiency to increase the level of electricity. This situation was complicated by the loss of Ukraine's power plants in the energy systems of the Autonomous Republic of Crimea and Donbas. The decision of the urgent problems of energy led to deliberate discussion of the draft law "On state policy on energy security". A series of complex amendments to the bill on the legalization of energy logistics and its separate aspects are proposed.
