ДО ПИТАННЯ ВЗАЄМОДІЇ СЛІДЧИХ З ОРГАНАМИ ТА ПІДРОЗДІЛАМИ НАЦІОНАЛЬНОЇ ПОЛІЦІЇ УКРАЇНИ ПІД ЧАС РОЗСЛІДУВАННЯ КРИМІНАЛЬНИХ ПРАВОПОРУШЕНЬ

Abstract
The article is devoted to the study of the main directions of the interaction of investigators with bodies and units of the National Police of Ukraine during the investigation of crimes under the current criminal procedural legislation. Content and essence of interaction are figured out, its main forms are determined. It is noted that the procedural form of interaction is carried out in accordance with provisions of the CPC of Ukraine, and organizational one – according to interdepartmental and departmental statutory enactments of the MIA of Ukraine. The main principles of interaction during the pre-trial investigation of crimes are established. Attention is drawn to the fact that the interaction between the investigator and other police units can also be at the stage of legal proceeding of materials of criminal proceedings. On the basis of the analysis of interagency and departmental normative acts of the Ministry of Internal Affairs of Ukraine, organizational forms of interaction are defined, which are manifested during: joint work in the investigative and operational groups that provide the comprehensive use of forces and means of investigation units, operational officers, criminological inspectors and other services under the leadership of investigator; mutual exchange of information between investigators and other units of the National Police; carrying out joint investigations and measures during pre-trial investigation and trial of materials of criminal proceedings. Attention is drawn to the fact that the interaction between the investigators and other police units may also be at the stage of judicial review of criminal proceedings, when the court with the aim of verifying and clarifying the evidence obtained during the trial, has the right to entrust the investigating authority to perform certain investigators (wanted) including secret investigative (wanted) actions, or upon receipt of a court order announcing the prosecution of the accused. The basic principles of interaction during the pre-trial investigation of criminal offenses are defined, namely: rapid, complete and unbiased investigation of criminal offenses; independence of the investigator in procedural activity; optimal use of available facilities of pre-trial investigation bodies and other police units; observance of the general principles of criminal proceedings; ensuring non-disclosure of pre-trial investigation data.
