Abstract
The article reveals the meaningful components of the notion of judge's discretion, which is a multidimensional phenomenon that contains objective and subjective components. The objective component includes the legal factors envisaged by the law: «court judgment» in procedural law means the choice of the court of one of the variants of already proposed decisions, which are prescribed by law. The subjective component includes the psychological factors that influence the perception of the judge of the specific circumstances of the case.Under the «internal conviction» of a judge is understood the possibility of taking into account in the process of solving a particular court case, the peculiarities of the life situation; In the presence of gaps in law or conflict of laws - to decide on the basis of their own understanding of law or the analogy of the law. Delegation of discretionary powers to courts is explained by the availability of ambiguous concepts for understanding the concepts and terms in the legislation. When making a judicial decision, the judge makes a discretionary choice to determine the relationship between objective and subjective goals, the achievement of which is the law.
