ECCLESIASTICAL COURTS - COURTS OF THE CHURCH OF ENGLAND

Abstract

The aim of this paper is to briefly present the judicial system of the Church of England. The state elements of this system are striking to continental readers: as the Queen is the head of the Church, the courts have the status of royal courts; the legal base and rules of procedure are laid down in measures, which are ecclesiastical legal acts having the same legal force as acts of the Parliament. This paper analyzes the legal basis, the structure of the courts, their particular features, and the position of a chancellor; also some procedural issues, e.g. the right of appeal, are mentioned. Special attention is paid to the mutual relationship between the ecclesiastical courts and (classical) state courts. Some examples of judgements are quoted to underline the power of precedence, typical for the common law system. Some remarks concerning the position of ecclesiastical courts in Wales and Scotland conclude this paper.
