ECONOMIC AND LEGAL FRAMEWORKS OF DEVELOPMENT OF A LEGAL ECONOMY IN THE UKRAINIAN SYSTEM OF INCOME FORMATION

Abstract

Problem setting. Problems and contradictions in the area of population incomes in Ukraine require a complex economic and legal approach to settling these matters. Recent research and publications analysis. Scientific papers of J. Buchanan, F. Farina, N. Berggren, W. Block, T. DiLorenzo, etc., are dedicated to research of development of a constitutional economy concept. H. M. Andreieva, P. D. Barenboim, H. A. Hadzhyiev, S. Yu. Danylov, P. O. Dobrodumov, A. V. Zakharov, V. D. Mazaiev, V. O. Mau, O. V. Skupinskyi have significantly contributed to development of the constitutional economy theory. Nevertheless, a matter of development of the legal economy in the Ukrainian system of income formation has not been settled. Paper objective. The article objective is to indicate the economic and legal frameworks of development of the legal economy in the Ukrainian system of income formation. Paper main body. The economic frameworks of the legal economy in the Ukrainian system of income formation are as follows: competitive environment development; reduction of economic areas conducing to corruptive relations between business and state; deregulation of the economy; reduction of discretional powers; growth of governmental officials’ salaries; increase of financing political parties from the state budget. The legal frameworks of development of the legal economy in the area of earning income include: formation of the normative and legal basis of total controlling incomes, property, and expenditures of governmental officials, politicians, and affiliated persons; formation and initiation of the effective activity of new anti-corruption bodies; radical renovation of staffs of the current law enforcement and court bodies. At the first phase of reforms, it would be useful to found an international anti-corruption tribunal. Conclusions of the research. To develop the legal economy in the Ukrainian system of income formation, it would be appropriate to change economic and legal mechanisms of income formation. Such reforms require a pressure on the part of the civil society and western partners of Ukraine.
