El acceso a la educación superior como derecho humano

Abstract

This paper analyses the central aspects of access to higher education as a human right, since the proclamation of the Universal Declaration of Human Rights in 1948. The study focuses on the problem of educational exclusion of the poorest groups in socio-economic terms, starting with the Constitution of the Republic of Ecuador of 2008 and the Organic Law of Higher Education. Based on this foundation, the objective is to carry out a critical-reflexive analysis around the functioning of the Higher Education System in Ecuador, based on the rules offered by the above-mentioned law. To this end, a qualitative methodology focused on the literature review was used. The information obtained made it possible to determine the main doctrinal and legal documents that have made it possible to achieve the objective. As a result, the Ecuadorian legal system has proved insufficient to guarantee the effective exercise of equal opportunities, on the basis of their respective merits, in order to gain access to academic and vocational training with the production of relevant knowledge and excellence and Therefore, additional strategies are imperative to guarantee the access and permanence of these unprotected sectors in the higher education system.
