ELECTRONIC DEMOCRACY IN THE CONTEXT OF THE EUROPEAN CHARTER OF LOCAL SELF-GOVERNMENT

Abstract

This scientific article is devoted to the indagate of the category “electronic democracy” and the concept of the mechanism of its application. Electronic democracy as an actual phenomenon is examined through a reference to a document called “European Charter of Local Self-Government”. The Charter was adopted on 15 October, 1985 by the Congress of Local and Regional Authorities of the Council of Europe (Congress of the Council of Europe). The Charter defines the purpose striving to ensure the implementation of local government rights and their protection. It is important that the Charter is an international treaty. The Charter, therefore, takes precedence over the national legislation of each of the states that have signed and ratified it. The Charter obliges states to consolidate in domestic legislation and apply in practice a set of legal norms guaranteeing the political, administrative and financial independence of municipalities. It also establishes the need for constitutional regulation of the autonomy of local self-government. These local state authorities are the closest to citizens; they are a medium that allows citizens to participate in developing projects and making decisions that affect the conditions of their daily lives. Another goal of the Charter is to give real substance to the main principles declared by the Council of Europe: the development of democratic consciousness in the territory of Europe (which is relevant for Ukraine, which seeks to become part of the European Union), a guarantee of the protection of human rights (the term is used in the meaning proposed by the Declaration of Human Rights which was adopted in the 1948). This document and its mechanisms are aimed at demonstrating the fact that the measure of autonomy of local self-government bodies is the main marker of real democratic processes. The principles of transparency, transparency, publicity, openness, fairness and equal access of all members of society, declared by the Charter, are ensured through the use of e-democracy and e-government.
