Examining the Reasons for the Non-Stipulation of the Constitution on the Condition of Gender in the Authority of High Ranking Political Officials

Abstract

This article seeks to analyze the principles of constitution review in the constitution stipulating gender leadership. Despite the prevailing view in the tradition Sex for leadership, as the highest political office, but none of the principles of the constitution refers to this. Silence constitution on the grounds that the conditions necessary for leadership means to be unnecessary of gender for this position. Although this issue is still in the fields of culture and society does not provide executive. Theoretically and legally, there is no limit to the enterprises led by women and constitution has enough capacity to fill all of the women's political authorities. چکیده در اصول مختلف قانون اساسی جمهوری اسلامی ایران شرایط لازم برای تصدی مقامات عالی رتبة سیاسی به تفصیل بیان شده است، اما غالباً تصریحی به شرط جنسیت وجود ندارد. همین امر موجب گردیده تا تصدی زنان به مناصب سیاسی همچنان مورد بحث و نظر قرار گیرد. با وجود رویکرد فقهی مشهور مبنی بر اشتراط جنسیت برای تصدی مقامات ولایی و قضایی، این سؤال مطرح است که چرا قانون اساسی به طور صریح به این شرط اشاره نکرده است؟ این نوشتار در پی این هدف است تا ضمن تحلیل دیدگاه‌های فقهی- حقوقی دربارۀ لزوم اشتراط جنسیت برای مناصب عالی سیاسی، دلایل سکوت قانون اساسی را مورد واکاوی قرار دهد. نگارنده بر این باور است که عدم تصریح برخی شرایط نظیر جنسیت، نشان از دقت نظر تدوین‌کنندگان قانون اساسی برای بالا بردن ظرفیت قانونی و باز گذاشتن راه تفسیر قانونی بر این امر بوده است. بنابراین هر چند زمینه‌های فرهنگی و اجرایی این مسئله هنوز در جامعة ایران فراهم نیست و بستر لازم برای مدیریت سیاسی زنان حتی در مناصب میانی نیز ایجاد نشده، ولی به لحاظ نظری و در مقام شناخت و دفاع از اصول قانون اساسی می‌توان گفت، قانون اساسی جمهوری اسلامی ایران ظرفیت نظری لازم برای تصدی همۀ مقامات سیاسی از سوی زنان را دارد
