FEATURES OF CRIMINAL LEGISLATION IN THE FIELD OF CORRUPTION CRIMES

Abstract
This article deals with the criminal rules of law which define corruption offenses. There were analyzed features of the corruption crimes that distinguish this group from other crimes stipulated in the Criminal Code of Ukraine. The scope of corruption crimes is a sphere of public services in which authorities exercise not only public authorities and local self-government but also officials of legal entities of private law – enterprises, institutions, organizations whose activities are aimed at meeting the needs and requests of citizens, legal entities and organizations. Corrupt crimes are characterized by specific features of the object and the objective side of the crime. Therefore, unlike other types of crimes enshrined in the Criminal Code of Ukraine, the sign of a common generic object is not mandatory for a group of corruption crimes. Thus, the act of a person committing a particular crime must be due to her official position or is related to the unlawful use of her official authority. A classification of corruption crimes has been made on various grounds. On the basis of the study of characteristic features, we propose to divide the corruption crimes by the subject of committing: 1) crimes committed by special subjects; and 2) crimes committed by general subjects; and on the subject of responsibility to divide them into: 1) crimes against which individuals are being prosecuted and 2) crimes whose responsibility lies with legal persons.
