GENERAL THEORETICAL ANALYSIS OF NATURE AND NATURE OF RIGHTS: SPECIAL QUESTIONS

Abstract
The article studies the problems of creating norms of law. It is stated that there is no unanimity on the delineation of such concepts as law-making, rule-making, law-making, legal education, law-making, establishment or sanctioning, etc., and also about the content of each of these legal terms. The author draws attention to the fact that basically almost all scholars in the field of law hold the position that, nevertheless, it is necessary to distinguish between law-making from a broader and multifaceted concept - the formation of law or law formation. It is proposed to proceed from the understanding of legal formation as a legitimate activity of legal entities, in the process of which, under the influence of specific objective requirements, spontaneous legal relations are formed, proceeding from the ordinary sense of justice, which are subsequently sanctioned by the state.
