Abstract
The gloss refers to three judgments of the Supreme Administrative Court – of 4 July 2012 (court file No. II GSK 917/11), of 19 December 2012 (court file No. II GSK 1823/11), and of 6 February 2013 (court file No. II GSK 2171/11). In practical terms, however, it addresses an established opinion of the Court concerning administrative fines imposed pursuant to the provisions of Food Law (Article 40a of the Act on Commercial Quality of Agri-food Products). The Supreme Administrative Court views administrative liability as completely independent of guilt and even of perpetrator’s awareness of having committed an offence. Instead, it focuses solely on determining whether the conditions set out under Article 40a have been met. In the gloss, the author presents the case law of the Supreme Court, the Constitutional Court, the European Court of Human Rights, and the Court of Justice of the European Union regarding the topic researched. Based on the judgements, the author forms a critical opinion of Supreme Administrative Court’s views. Furthermore, the author argues for taking the perpetrators’ contribution to the offences committed into consideration in the process of imposing administrative fines.
