Guardianship and Care of the Second Rzeczpospolita (1918–1939) and the Ukrainian SSR: a Comparative Analysis

Abstract

One of the deterministic approaches to the ethnopsychological distinction between the western and eastern regions of Ukraine is demonstrated: their long stay under the influence of various types of state-legal regulation (Polish, Austro-Hungarian, Romanian on the one hand, and Russian on the other). It is noted that among the many branches of legislation, ethnopsychological factors are most demonstrated while influencing their formation by the norms of family law, in particular those that regulate legal relations, the subjects of which are children, especially those who are deprived of the traditional family environment. A comparison of the strong and weak aspects of Soviet and Polish models of guardianship and care was made (Poland at that time in the Soviet Union was considered as bourgeois society). In general, it is summarized that attempts to restore in full the “socialist” model of guardianship of orphans and children deprived of parental care, are impossible and somewhat inappropriate in modern Ukraine. This is explained not only by the lack of funding, but also by such other factors as ideological, cultural, human rights, and the like. It is also unwisely to reproduce in the pure form the experience of Western Ukraine in the interwar period. However, the positive aspects of both models should be studied and used by the newest national system of care.
