Law and a Child

Abstract
This article indicates to the reasons and the need to guarantee of children a separate legal status and the adequate reinforced protection in various fields of social life. The Author emphasizes well-being of a child and well-being of a juvenile (that is a child that committed punishable acts or showed other signs of demoralization) as the supreme directive of the international and internal law, applicable in all cases pertaining to minors. The Author pays particular attention to presentation of the system of special penal-law protection guaranteed to children pursuant to the provisions of the Polish Penal Code, Petty Offences Code and other acts. She indicates to the need of application of preventive actions against harming or neglecting children. In case of small children, who are most defenceless, these functions could be fulfilled e.g. by general compulsory pre-school education (nursery school) from the age of 3.
