LEGAL FACILITIES AS CONSTITUENT OF LEGAL REGIME FROM THE POSITIONS OF THE INSTRUMENTAL THEORY OF LAW

Abstract
The article is devoted to the clarification of the understanding and the essence of such a legal category as “legal facilities” from the point of view of the instrumental theory of law. The author emphasizes that legal means are elements of legal reality that act as regulatory phenomena and which, in the system interaction and in conjunction with other elements of the system of social regulation, function in order to achieve the goals and tasks that are at a certain stage of development society and state. The emphasis is on the fact that the application of the legal regime is based on the need to use a special set of legal facilities.
