LEGAL MEANS OF FORMING LEGAL CULTURE OF LAW ENFORCEMENT OFFICERS

Abstract
The article is devoted to theoretical and practical aspects of the formation of the legal culture of law enforcement officers. The concepts of the legal culture of society, the legal culture of the individual and legal education are analyzed. Positive and negative factors that influence the formation of the legal culture of citizens are singled out. It is noted that the formation of the legal culture of law enforcement officers of Ukraine occurs in conditions of ideological uncertainty, which is aggravated by the continuing economic crisis, the negative impact of globalization processes. It is noted that “legal means” are a key category of instrumental theory of law. In a broad sense, legal means are a system of legal forms, methods and techniques for achieving private or public goals by participants in legal relationships. This approach to understanding the law allows us to perceive it not as a set of imposed by the state bans, duties and permits, but as a system of real tools for satisfying the needs, realizing the interests of the individual, society and the state as a whole. Suggestions are made regarding the improvement of forms, methods and specific legal means of legal education of law enforcement officers in modern conditions. The conducted research of legal means of formation of legal culture of employees of law enforcement bodies has allowed to formulate a conclusion that the core of legal culture of law enforcement officers is knowledge of the profile legislation, including departmental regulatory legal acts, and also set of skills of its application. The key element of the legal culture of the law enforcement officer is the principle that “only what is clearly defined by law” is allowed in conjunction with a clear legal orientation towards respect for human rights and freedoms (inadmissibility of exceeding authority and violation of fundamental human rights and freedoms). The second necessary element is a feeling of intolerance towards any manifestations of corruption, which should be perceived as an antipode of law, the greatest threat to statehood, and this feeling must be reinforced by the certainty of the inevitability of punishment for corruption offenses. To specific legal means of forming the legal culture of law enforcement officers should include: the legal regulation of a hard and independent competitive selection of candidates for the relevant positions, the establishment in the criminal law of increased legal responsibility for corruption offenses for law enforcement officers, a clear legal regulation of public control over their activities in the prospective Law of Ukraine “On public control”, legal regulation is mandatory on the improvement of professional skills of law enforcement officers in higher educational institutions of the legal profile every three years with the passage of re-certification. This list is not exhaustive, given the complexity of this subject, which, in turn, determines the prospects for further research.
