Legal status of persons acquiring administrative posts in the Highest anticorruption court.

Abstract

The scientific approaches to determining the legal status of administrative positions of the Higher Anti-corruption Court are highlighted. The norms of the Laws of Ukraine "On the Judicial System and Status of Judges" and "On the Highest Anticorruption Court", which determine the legal status of the chairman of the court, the head of the court apparatus and their deputies, are analyzed. The article shows that administrative positions at the HAC are Head of the Supreme Anticorruption Court, his deputy, head of the apparatus of the Supreme Anticorruption Court, his deputy, head of the apparatus of the Appeals Chamber of the Supreme Anticorruption Court and his deputy. It is proved that administrative positions in the Supreme Anticorruption Court are the structural elements of the Higher Anti-Corruption Court as a state body, defined by law and staff regulations, which is a legally established set of administrative rights and responsibilities (administrative powers) regarding organizational leadership in the Supreme Anticorruption Court in order to ensure the implementation effective anti-corruption justice. The proposals on amending the Law of Ukraine "On the Highest Anti-corruption Court" are formulated, specifying the legal status of the head of the court, the head of the court apparatus and their deputies as persons holding administrative positions. A further thorough investigation will be required of the practice of implementing the administrative powers of the Chairman of the Supreme Anticorruption Court, his/her deputy, the Chairman of the Appeal Chamber of the Supreme Court, the staff-head of the Supreme Anticorruption Court and his deputy in order to identify the shortcomings of the legal regulation of judicial administration and identify areas for improving anti-corruption legislation.
