LEGAL TERMINOLOGY AND ITS ORDERING PROBLEMS

Abstract
In the given article the problem of unification and standardization of the legal terminology in the modern Ukrainian language is considered. The topicality of the article is due to the lively interest to lexical, grammatical and pragmatic aspects of studying the Ukrainian legal terminology. The goal of the article is in the analysis and rating of legal terminology in the Ukrainian language unification criteria, and also in making an algorithm of the legal terminology unification and in determination the main functions of the legal terminology unification. In the article the main recent researches are analyzed which were dedicated to the unification and standardization of modern legal terminology in the Ukrainian language. It was pointed that the problem of the insufficient research of legal language consists in the problem that the domestic legislators use the legal terminology not in full measures and the linguists not enough investigate the problems of the legal language as the peculiar functional style of the literary language. It was found out that the legal terminology unification is the totality of acceptances and means which were focused on getting legal terminology unity, its uniqueness and for the prevention synonyms, contradictions and discrepancies in meaning and writing the terms. Also two stages of the Ukrainian legal terminology unification were distinguished. On the preparatory stage the terminology selection which is subjects to be unified is occurred. As a rule the selection is got after analysis of actual regulatory legal acts. During the second stage is necessary to make an accounting of all Ukrainian denotations of the certain legal reality. The important point is the elimination of archaisms and some lexical units which are out of the normative language base especially slang, argot, vulgarisms, etc. On the last, final stage of the Ukrainian legal terminology unification we analyze the terms which are the rest in the selection from the point of their stability of using in legislative and regulatory legal acts. The main functions of legal terminology unification were distinguished, in particular, cognitive, practical, ideological, communicative, prognostic, regulative, control, preventive. It was identified that the unification of abbreviation needs more thoroughly work because to get integrity in this sphere is harder, in any language system different legal reality can be response to different abbreviations. Such steady reductions are necessary to study as a part of legal terminology which is also to be unified. It was proved that the result of any unification is making a consistent system of regulatory legal terminology which will keep in right order all legal terms which are used in legislation on the current stage and will help to organize to harmonize using this or that legal and legislative realities in present day life. It is noted that the perspective of further researches in this question consists in the analysis of developing the linguistic investigations in the sphere of legal terminology and also in possibilities of using received results during studying lexicology, grammar, pragmatics of the modern Ukrainian language.
