MAIN COMMERCE LAW MEANS OF THE STATE TECHNOLOGICAL SAFETY SECURE

Abstract
This article examines several economic and legal means of national technological safety ensuring. The legislative and conceptual economic-legal means of ensuring technological safety of Ukraine are analyzed. This article analyzes the several systems of the basic economic and legal means of providing national technological safety proposed by scientists. It has been found out that in the scientific literature there is no single approach to the system of basic economic and legal means of providing national economic security in general and in certain spheres. The economic and legal means specified in art. 12 of the Economic Code of Ukraine were analyzed and was made a conclusion that it is necessary to expand their list. Attention is drawn to the necessity of making changes in the domestic legislation in the field of regulation of relations related to state subsidies, since at present this means of ensuring national technological safety is almost not involved in the mechanism of ensuring national technological security. The legislative definition of the concept of "state grant" is analyzed and its improvement is proposed. It is noted that due to the exclusion of the concept of subsidy from the Budget Code of Ukraine it is almost impossible to apply this state mean of ensuring technological safety of the country. The importance of increasing the value of forecasting, as one of the main means of ensuring national technological safety, is indicated. The importance of adopting such a number of program documents in the innovation field is emphasized, namely: the ensuring of technological safety of Ukraine State Program, the Development of Critical and Basic Technologies in Ukraine State Program, the Development of the Technology Market of Ukraine State Program, etc. The necessity of creating a single integrated legal mechanism that should contain effective means of economic and legal influence on the state economy and innovation sphere is underlined.
