Mass Media as Actors of Public Control over the Activities of Judicial Authorities

Abstract

The article is devoted to the study of theoretical and legal issues of the public control exercised by the mass media over the activities of the judiciary. Establishing a constructive relationship between the media and the courts will facilitate interaction between the state and civil society (the public). So, if a state is responsible to a human, it means that a human can ask the state in the person of the authorized bodies of state power about their activities, for example by exercising public control. However, it should be noted that the implementation of such a right in Ukraine is still insufficient and not always effective. The essence of the term “public control” is defined. The processed material made it possible to formulate the definition of the concept of public control as one of the types of social control carried out in the form of a public audit of the activity (results of activity) of state authorities and local self-government using, in accordance with the Constitution and Laws of Ukraine, a complex of legal, organizational, informational measures by citizens. and their associations in conditions of development of a sovereign, independent, democratic, social, legal state. The purpose of public control over the activity of state authorities and local self-government is to facilitate their effective work and fulfillment of their functions, implementation and protection of rights, freedoms, and interests of citizens. The legal and regulatory framework for the implementation of public control over the activity of the judiciary is analysed. In Ukraine, European integration has turned into a comprehensive internal reform policy, actualized the issue of public control, which is an integral part of public administration, as well as the most important factor in the development of civil society. Thus, Ukraine’s future accession to the EU implies compliance with generally accepted international norms and standards. The executive and legislative branches of the government are making efforts towards public participation in the control over the activities of state authorities, but in practice the effectiveness of their implementation and application remains low. The practice of the European Court of Human Rights in the field of public control over the activities of the court is considered.
