Abstract

The third part of the article presents comparison between mediation and following ADR methods: summary jury trial, binding mediation, early neutral evaluation, dispute review boards, consensus building, rent-a-judge, baseball arbitration (final offer arbitration), high-low arbitration, online dispute resolution, role of ombudsmen, conciliation, facilitation, panel of experts, special master. This juxtaposition leads to the conclusion that most of these methods cannot be successfully used in resolving family disputes, mostly because they do not provide the confidentiality of the proceedings. Therefore mediation often is the only alternative dispute resolution method that allows parties to resolve family dispute outside the courtroom. From all the methods described in all parts of this paper de facto only negotiation, collaborative divorce and special master along with mediation are used in family matters. Other, like fact-finding, could be used more widely, but so far did not gain popularity in this types of disputes. Other methods are yet too expensive, comply only with the common law system, engage too many people in resolving process or provide no legally binding solution to the dispute and therefore will never be adopted widespread in family disputes. For this reasons mediation seems to be the most accessible, best suited and well-regulated form of ADR for terminating family disputes.
