Abstract

It is crucial to know which of alternative dispute resolution methods are considered best for a given type of the dispute. This knowledge not only allows parties to choose the method that suits their dispute best but also enables lawyers to advise the right procedure to their clients. There may be many factors taken into account when making that decision: entities conducting the proceedings, legal regulation of the method, costs, enforceability of the agreement, the course of the proceedings etc. The aim of this article, which will be presented in 3 parts, published in 3 consecutive ADR Arbitraż i Mediacja issues, is to decide which of the ADR methods is best for resolving family cases in Poland. So far, the most common is mediation and therefore we need to see what the strengths and weaknesses of other methods are in comparison to it. This part of the article defines ADR methods, shows that there is no numerus clausus of ADR methods that can be applied to the dispute and discusses basic divisions and groups of ADR methods to get a better understanding of them in further parts.
