Напрями вдосконалення організаційно-правових засад місцевого самоврядування в Україні / Directions Regarding Improvement of Organizational and Legal Principles of Local Self-Government in Ukraine

Abstract
The problems of understanding of local self-government as the foundation of civil society formation are being analyzed. The nature and system of local self-government are being highlighted. The author makes a generalization of scientific works on local self-government and its concept in this article. A legal regulation of the local self-government bodies’ activities in dynamics is considered. The directions of local self-government development in Ukraine and the states of the European Union are mentioned. The constitutional and legal principles of the local self-government organization are also analyzed and the ways of development of the local self-government constitutional and legal basis are determined. The approaches to the definition of "local self-government" are considered, the peculiarities of the local self-government organization models are disclosed, taking into account the administrative and territorial order, historical, financial and other conditions of the territories development. The basic principles of the European Union, basing on local self-government, are analyzed. The author proposes to implement a real district and regional self-government, requiring a precise competences division between the territorial self-government levels, as well as the economic basis implementation, in which the communal ownership of the regional and district territorial communities may act as a communal property. Proposals for the municipal code implementation, which should become the basic аct for a local self-government system establishment, have been developed. Its codification will help to overcome the crisis, the legal basis of local self-government, eliminate gaps in legislation and effectively implement the Law norms.
