NEW FUNCTIONS OF THE AGRICULTURAL PROPERTY AGENCY IN POLAND IN VIEW OF THE AGRICULTURAL SYSTEM STRUCTURING ACT OF 5 AUGUST 2015

Abstract
\e Agricultural Property Agency is a legal entity that is wholly owned by the State. It was established in 1991 and tasked with a number of responsibilities that changed over time. Presently, the Agency continues to ful#l the custodian function which means that it acts in legal transactions on its own behalf and for the bene#t of the State Treasury. However, the control of trading in agricultural property by way of instruments provided for under the new Agricultural System Structuring Act should be considered the primary function of the Agency. \e control of trading is characterised by a high level of restrictions, which together with the related limitations on sales may lead to informal trading in agricultural property and the related negative consequences. However, what gives rise to the biggest concerns is equipping the Agency with tasks and functions that actually restrict the owners in exercising their ownership rights; such tasks and functions being thus questionable in view of their constitutionality and conformance to the EU law.<br/><br/>
