“NONPOSITIVISTIC” LEGAL THINKING AS A MEANS TO OVERCOME THE CRISIS OF THE CRIMINAL SECTOR: MYTHS AND REALITY

Abstract
The problem of correlation of such concepts as law and legislation in the criminal legal plane has been analyzed in the article. The unreasonable confusion of content of the norms of law and other social regulators has been argued. The conclusion is drawn that the domestic criminal law can only be “positivistic”.
