Abstract
The article provides an author's view on a normative and legal content of the basis of criminal proceedings - access to the court and a binding nature of court decisions. It is emphasized that international human rights instruments and case-law of the European Court of Human Rights have adopted a distinction between the notion of access to a court and a fair trial as separate elements of the right to justice. At the same time, the current version of Part 1 of Art. 21 CPC Ukraine does not take into account this distinction and actually identifies access to justice with a fair trial, which is not fully consistent with the content of other general principles of criminal proceedings and does not quite accurately reflect the essence of access to justice. The authors support an expediency of using the term "access to a court" instead of "access to justice", taking into account it’s appliance for judicial and pre-trial proceedings. There is substantiated a necessity of establishing the requirement to ensure the right to access to court as a free opportunity for everyone to apply for judicial protection of their rights in the content of the relevant principles of criminal proceedings. It is also offered to consolidate such a significant procedural component of access to the court and the binding nature of a court decisions as ensuring real access to procedural acts adopted during criminal proceedings and relating to the rights and duties of a person, directly in the text of the current CPC of Ukraine.
