Objects of justice in civil cases: resolution of case or protection of right, as criteria for evaluation of effectiveness of civil litigation
Journal Title: Relații Internaționale Plus - Year 2019, Vol 1, Issue 15
Abstract
In article it is differentiated such problems of civil litigation, as «resolution of a case» (resolution of a dispute) and «protection of a right» (reinstatement of rights) as a criteria for evaluating of effectiveness of justice in civil cases. It is concluded that since the effectiveness of justice in civil cases indicates the degree of realization of its objectives, the effectiveness of civil litigation should be considered in two aspects: procedural - as a timely consideration of the case and correct resolution of the dispute; substantive - as an effective protection of violated rights.
