ОГЛЯД РЕАЛІЗАЦІЇ ВИБОРЧИХ ПРАВ ДЕЯКИХ КАТЕГОРІЙ ГРОМАДЯН В ЧЕСЬКІЙ РЕСПУБЛІЦІ

Abstract

The unhindered realization of the electoral rights by the citizens who have the right to vote is one of the main principles of a modern democratic country. Unfortunately, in Ukraine today there are certain legislative gaps and problems concerning the realization by citizens of their constitutional capacities, in particular, the right to an all-Ukrainian and local referendum, the impossibility of internally displaced persons to vote in local elections, and the imperfection of the electoral system of people's deputies of Ukraine. Improving and resolving the current shortcomings of electoral legislation will be impossible without studying and analyzing the relevant provisions of the electoral law of the countries that are partners of Ukraine and constantly supporting it towards bringing domestic legislation to the standards of the European Union. Especially if it concerns sufficiently narrow electoral institutes that do not yet have sufficient domestic research. The study of electoral legislation in Ukraine and foreign countries was carried out by such domestic researchers as: Y.G. Barabash, І.І. Bodrova, Y.B. Klyuchkovsky, O.V. Martselyak, M.O Lundel, S.G.Seryogina, T.V. Stetshenko and others. However, in domestic science, attention was not paid to the study of foreign experience in the provision of electoral rights in the countries of the Visegrad Group, in particular, the Czech Republic. Therefore, it seems relevant to focus on highlighting Czech legislation in terms of ensuring the exercise of the electoral rights of certain categories of persons. The article examines the electoral legislation of the Czech Republic for the purpose of ensuring the suffrage of certain categories of persons. It is noted that it is the legal basis of the electoral and referendum process in the state. Particular attention is paid to the analysis of the implementation of the electoral rights of such categories of persons as incapacitated persons, citizens living abroad and persons who are in the cities of restriction or imprisonment. It is interesting to highlight the realization of the active and passive electoral rights of citizens of the European Union at the local elections in the Czech Republic. The laws of the Czech Republic adequately regulate the electoral rights of citizens residing abroad, in particular, the law provides for the possibility to participate in national elections, regardless of whether they lived in the Czech Republic or how long they were abroad. At the same time, the legislation does not provide for the possibility of voting by mail, as provided in many EU countries, in particular Poland. We consider a certain disadvantage of the legislation and the fact that the citizens of the EU do not have equal active and passive voting rights in local elections, as citizens of the Czech Republic. In practice, citizens who wish to take part in the elections must have lived in the territory of the Czech Republic during the last five years. Passive electoral rights of EU citizens (both in local elections and in elections to the European Parliament) are complicated by the fact that citizens can not be members of political parties. The current situation is discriminatory and is not in line with EU law. However, the solution of the problem does not necessarily have to be provided by amendments to the law, it is possible to use the interpretation of the legal concepts of the European Union.
