ON THE CONCEPT OF THE INSOLVENCY OF BANKING INSTITUTIONS

Abstract
Recognition of a bank as an insolvent one has a legal consequence of the violation of statutory restorative and liquidation procedures concerning this institution and is also a prerequisite for ensuring the rights and interests of third parties and founders. The concept of solvency of a banking institution at various times was investigated by numerous economists, financiers, and lawyers. However, the concept of solvency is not clearly correlated with related economic concepts, the measure of formalization of the state of insolvency as an element of the capacity of the banking institution and its ability to carry out banking activities is not defined. The article is devoted to the analysis of the concept of the insolvency of a banking institution at the current stage of economic and legal reforms in Ukraine, the regulatory requirements for the procedure for recognizing the bank as insolvent; differentiated economic and legal signs of the insolvency of banks, and formulated conclusions and proposals aimed at improving banking legislation in this area. The necessity of replacing the concept of the inability of banks to pay with the concept of its insolvency is substantiated.
