ON THE ISSUE OF THE PLACE OF SPORTS LAW IN THE LEGAL SYSTEM: THE EXPERIENCE OF THE EUROPEAN UNION COUNTRIES AND THE USA

Abstract
The article analyzes different approaches to understanding the concept of “sports law” and defining the place of sport law in the legal system existing in the European Union and the USA. It is obvious that the recognition or non-recognition of the concept of sports law as a separate field of law in the European Union and the USA entirely depends on the understanding of the essence of the legal system, and the place of the sports law in this system. In most cases we observe a complete mix of categories such as the legal system, the system of legislation, the law, as scientific doctrine and the law, as academic discipline. Obviously, most authors do not distinguish sports law as a branch of law and the field of sports legislation, and some researchers perceive these categories, along with doctrine and discipline, as a whole. Perhaps this approach is justified for the Anglo-American legal tradition, but for the Roman-Germanic system it is not relevant. With regard to the recognition of sports law as a separate branch of law, then such reasons, obviously, are not enough. And given the diversity of approaches to understanding the essence of sports law, let us assume that in fact the relevant dispute between European and American researchers in this regard is nothing other than a dispute about the existence of a separate branch of sports legislation. At the same time, processes of convergence of the legal systems of countries within the European Union and with the USA, as well as the development of sport as a single global system, within which there are hierarchically structured federations of kinds sports, make the process of convergence of these two systems inevitable and necessary. In fact, separate elements of the two legal systems have already been merged to implement the legal regulation of various sports relations. In particular, the jurisdiction of CAS extends to disputes that arise in all countries, regardless of belonging to a particular legal family. At the same time, the status of CAS differs from the status of other arbitration tribunals in the countries of continental law. And the corporate rule-making of sports organizations goes far beyond the limits of the local rule-making of corporations at the national level. Consequently, one should agree with the position of the CAS regarding the actual existence of sports law as a separate sphere of legal regulation, but there is hardly any reason to assert the existence of a sports law as a separate branch of law, at least in the classical sense of the concept. At the same time, one should be aware of the difference in approaches to understanding the system of law in different legal systems. Of course, the task of representatives of both legal systems, both continental and Anglo-American, is to seek the possibility of unifying the legislation in the field of sport, taking into account the peculiarities of both systems.
