ORDER OF FORMATION OF STRUCTURE AND POWER OF COUNCIL OF PUBLIC PROSECUTORS OF UKRAINE

Abstract
In article it is analyzed features of standard regulation of a legal status of Council of public prosecutors of Ukraine as а body of public prosecutor’s self-management. The attention is paid to times formations of structure of Council of public prosecutors of Ukraine and the requirement to its members, the list of powers who are given to Council of public prosecutors of Ukraine and procedure of their realisation. Offers are developed for improvement of standard definition of requirements to candidates on a post of a member of Council of public prosecutors of Ukraine and powers of Council in the Law of Ukraine «About Office of Public Prosecutor».Most of the powers of the Council of Prosecutors of Ukraine are necessary and characterize the Council as an organ of prosecutorial self-government. At the same time, we note that there is an imperfection of the regulatory definition of certain powers of the Council of Prosecutors of Ukraine in the area of appointing (dismissing) prosecutors to administrative positions, which requires its correction. It is necessary to correct the potential conflict in the Law between the Prosecutor General of Ukraine and the Council of Prosecutors of Ukraine regarding candidacies for administrative posts.In addition, in our opinion, the procedure for forming the composition of the Council of Prosecutors of Ukraine requires changes, since only such representatives as prosecutors should be members of such a body. Attention is drawn to the need to formulate a list of requirements for persons elected to the Council of Prosecutors of Ukraine: prosecutors with positive experience in the implementation of professional skills, experience in the prosecution, honest, having necessary business qualities.
