POLITICAL AND LEGAL REGULATION OF LIFE OF THE SOVIET COMMUNITY OF THE UKRAINIAN SSR IN THE 1920S

Abstract

In the article, based on the analysis of laws and regulations, monographic literature, an attempt to determine features of political and legal regulation of life of the Soviet community of the Ukrainian SSR in the 1920s is made. The author tries to identify means of the political and legal influence of the power on governance structures of public associations and unions, to trace how there were the destruction and liquidation of state-independent civil institutions in the early Soviet totalitarian society during the 1920s. In the first half of the 1920s, the Bolshevik leadership began to create the legal basis for activities of public associations of the new state of “proletarian dictatorship”. Even the first regulatory legal acts and regulations provided for establishing a total control from the side of Communist Party bodies for their activities. The policy of the Communist Party bodies found its continuation in the second half of the 1920s during the period of gradual collapse in the Soviet state of even those small political freedoms that were declared by the Bolshevik leadership in the early 1920s. In the first half of the 1920s, the Bolshevik leadership, without having strong power, conducted a policy aimed at the gradual absorption by the newly established state institutions of public institutions that functioned in the state. In parallel, the creation of a legal framework for monitoring the life of public associations took place. The power strived to monopolize the will of society, expressed by its representatives – public associations and unions. Civic organizations have constantly been threatened with closure for reasons such as the political unreliability of founders, the existence of organizations with duplicate functions, political activity, entrepreneurial activities, etc. The legal manifestation of the status of a public association was recorded in the legal status of the organization. Civic organizations, getting a privileged position, became as close as possible to party institutions, which led to a reduction in the degree of their organizational autonomy and functionality. Their leading asset was partially replaced by party functionaries, losing ground for manoeuvring. The policy of the Communist Party bodies found its continuation in the second half of the 1920s during the period of gradual collapse in the Soviet state even of those small political freedoms that were declared by the Bolshevik leadership in the early 1920s.
