POLITICAL IDEOLOGY AND CONSTITUTION: LIBERALISM AND NEOLIBERALISM IN THE CONSTITUTIONS OF 1979 AND 1993

Abstract

Political Constitutions represent the political ideology of a State at a given time, and are the product of the transition from one governmental context to another, which influences the social, economic and cultural development of a country. The purpose of this research was to recognize the political ideologies contained in the 1979 and 1993 Constitutions of Peru in order to analyze how they explicitly shape the State. Evidently, for spatial reasons, said analysis was carried out with greater emphasis on one of the constitutive elements of the state structure, which were considered the most important for the purposes of the investigation. The research was qualitative and descriptive-explanatory. The population was made up of the Political Constitutions of Peru, while the sample was the Constitution of 1979 and 1993 of the Peruvian State. The data collection technique was discourse analysis, interpretation of texts and application of a questionnaire, while the instrument was the semi-structured interview. It was found that, despite the fact that there are many important distinctions between the ideological conceptions of both constitutions, the liberal foundation, in its social democratic and neoliberal forms, is the one that prevails and gives structure to both and, therefore, to the State. Therefore, it was concluded that, regarding fundamental rights in the semantic aspect, the structure of the Peruvian State, the economic regime and the 1979 Constitution were of liberal ideology; while that of 1993 was neoliberal.
