ПОНЯТТЯ, СУТНІСТЬ ТА ЗНАЧЕННЯ ПОРЯДКУ ДЛЯ ПРОВЕДЕННЯ СУДОВОГО ЗАСІДАННЯ

Abstract
This article is dedicated to institute order during the court session, the essence of which is a behavioral block that procedural law in Ukraine is reflected in the provisions of fair use actors of their rights and responsibilities. It was clarified that the order in the court session contains objective and subjective elements. Objectives include the existence of law, norms, rules (regulator of behavior). To subjective – psychological (psychophysical conditions of life, upbringing), ideological (social environment, biological and social status, etc.), moral (moral development of personality, conscience, sense of duty, and much more). It is proved that the order during the court hearing - a procedural law set certain ritual behavior in court, which aims to ensure the necessary conditions for consideration of cases, due to the impact of litigation citizens, respect for court approval of the independence of the judiciary.
