Powers of Diplomatic Service Civil Servant

Abstract

Nature and ratio of diplomatic service civil servants’ powers with related legal categories are dealt with. The author addresses constituent elements of relevant authority. Classification of the diplomatic service civil servants’ powers is provided. Dynamics of the diplomatic service civil servants’ legal status has been considered. The diplomatic service civil servants’ have been perceived as a dynamic legal category of primary level that creates opportunities to meet public interest of the state and certain social groups in external relations. Rules of the diplomatic service civil servants’ conduct in foreign affairs have been researched into. The author focuses on specific features of professional competencies profiles. Implementation of powers by public administration, e. g. the Ministry of Foreign Affairs of Ukraine, has been illustrated as one of the main diplomatic service civil servants’ activities on the basis of, within and by the means established by law. The author highlights subjective rights and legal responsibilities the diplomatic service civil servants, emphasing different legal categories corresponding with different powers of these public servants. The diplomatic service civil servants’ rights have been described as implemented in legal relations with civil society. The obligations have been analyzed as exercised in legal relations with the state and embodied in interaction of public administration with citizens and foreigners. The author describes the diplomatic service civil servants’ powers as a synthesis of meeting national interest rights and obligations of these public officials on the basis of, where the scope of responsibilities is much wider compared to the scope of rights. A direct interdependence between constituent elements of the diplomatic service civil servants’ powers has been outlined. The diplomatic service civil servants’ powers have been classified according to their legal regime on interactive, publicly-managerial, organizational, analytical, regulatory, controlling and oversight. The proposed classification covers essential features and legal tools of these entities.
