ПРАВОВА ОХОРОНА ЗЕМЕЛЬ ТА ЇЇ ФУНКЦІЇ

Abstract
The article considers correlation of such notions as «land protection» and «legal land protection»; the definition of the «legal land protection» is given. The functions of legal land protection are described in details, in particular regulating, stimulating, controlling and punitive ones. It is emphasized that among norms which establish the rights and duties of land plots owners and land users and the regulations which establish norms and standards in the sphere of land use and protection it is appropriate to single out one more norm that is the norm which establish the rights and duties of state and other bodies that are responsible to secure rational land use and its protection and also the order of its realization. The stimulating function is characterized of positive and negative aspects; a wider interpretation of public control is suggested as a component of the controlling function. The idea to add the renovating function of the legal land protection to the list of all functions is supported.
