Правовая ментальность: интерпретации в научном дискурсе

Abstract
Раскрывается специфика толкования категории «правовая ментальность» в разных научных концепциях. Наиболее авторитетные направления изучения ментальности: социальная психология, которая основана на социологической теории Э. Дюркгейма; общая психология, теория архетипов как основы «коллективного бессознательного» К. Юнга, концепция «социального характера» В. Райха. В юридической науке до недавнего времени наблюдался оттенок определенной второстепенности и подчиненности правовой ментальности. Подобная категориальная второстепенность правовой ментальности сохранилась и тогда, когда этот термин начал активно использоваться в правовой науке. Доказывается, что понятие «правовая ментальность» имеет большой эвристический потенциал и должно находиться в центре современных юридических исследований.
