PROBLEMS OF LEGAL REGULATION OF QUALIFICATION REQUIREMENTS FOR EMPLOYEES AT HIRING

Abstract
Problem setting. The problem of labor potential conformity to modern requirements of economic and social development, to the needs of employers in the labor market is particularly acute today. The high requirements both professional and personal character relate to employees. In this regard the legal regulation of qualification requirements for workers at employment are relevant and prospective for research. Target of research. The study aims to identify the legal nature of qualifications description guides of workers, their value, principles of development, the ratio of guides to other regulations in the labor sphere. Article’s main body. The article examines the legal nature of qualifications discription guides of workers occupations as systematized by economic activity collections of descriptions of occupations that exist in the economy of Ukraine and also emphasizes their importance. The authors on concrete examples analyze the ratio of guides to other regulations establishing qualification requirements for certain categories of workers and certain sectors, consider basic principles on which the guides are developed. The study and analysis of legislation on qualification descriptions and requirements to fill certain positions indicates a differentiation in this regard and the lack of justification of some claims of unjustified change and inconsistency among certain provisions of the various legislative acts. It is therefore proposed to introduce necessary amendments to the Law of Ukraine «On the National Anti-Corruption Bureau of Ukraine», «On the Judicial System and Status of Judges» and «On Higher Education». Conclusions and prospects for the development. Based on the aforementioned it is concluded that the qualifications description guides are mandatory for use along with the norms of the Labor Code and other legislative acts of Ukraine; the qualifications description guides should be developed so that the contents of the main tasks and responsibilities of the employee meet the objectives of the existence of a sphere, and consistent with other regulations in the labout sphere. The authors make a number of proposals for improving the current legislation and emphasize the need to accelerate the development of qualification discription guides in those areas of the economy where they are today available (eg higher education).
