PROCEDURAL EQUALITY AS ELEMENTARY IMPLICATION OF SOCIAL DIALOG RULE

Abstract
This article is about one of elementary issues connected with social dialog principle, that is its influences on specific procedures of collective bargaining, regulated by Labour Code. Firstly, I consider essence of social dialog principle and correctness of grounds of a linking it with collective bargaining. I try to explain that this rule and collective bargaining are connected with semantic relation. I try also to prove that procedural equality is elementary implication of social dialog rule. In my opinion, basic aspects of that rule are informational duties and rights. I analyze farthest sequences influence of (income of) principle of social dialog on interpretation of provisions which regulate collective bargaining and possibility in a way of analogy application of regulation from XI selection Labour Code. In last part of article I consider results of infringements of principles of procedural equality during tive bargaining, particularly, capability of termination collective agreements and avoid legal effects of a declaration of will by social partners.<br/><br/>
